crucial date, 16th of April, 1899, did not become

British subjects, but the question was not put

expressly to the Law Officers and such a native who

happened to be temporarily absent on that date but

subsequently returned to the territory might well be

"

held to be an inhabitant.

If actual presence in the territory on the

crucial date is the criterion, the onus would be on

Fong Saw, notwithstanding the certificate he has

obtained as to his birth there, to prove that he was

actually present in the territory on that date.

If the Home Office desires we might put that

question explicitly to the Governor.

Office sending copy of the Law Officers' Report of

27th September, 1899.
